PEOPLES RURAL TELEPHONE COOPERATIVE DSL SERVICE
ONE-YEAR AGREEMENT
This Agreement is made by the individual or authorized person of the
organization ("customer") identified below and Peoples Rural Telephone
Cooperative (company). The company and customer agree to the following
conditions concerning Digital Subscriber Line (DSL) service provided by the
company to the customer.
Based upon network availability, PRTC DSL is a "best efforts" service, which can
provide Up Stream & Down Stream speeds selected by the customer. The actual
speed experienced by customers may vary and depend on several factors not
limited to but including customer location, the destination on the Internet,
traffic on the Internet, interference with a high frequency spectrum on the
customer’s telephone line and other devices that may be attached to the same
cable pair. No minimum level of speed is guaranteed without a specific service
agreement.
The company is not responsible for any external intrusion to the customer’s
network equipment. The customer is responsible for providing firewall protection
in an effort to help prevent intrusions. Since this service is an "Always On"
connection, it is the company’s recommendation that each customer has
appropriate firewall protection on their equipment when using PRTC DSL service.
The company is not responsible for any personal computer or network malfunctions
and or damage to the customer’s hardware or software. The company is providing
DSL service on a retail basis to the customer. The customer agrees to utilize
the service exclusively and not to provide access to third parties either
through "sharing" or "Resale".
Web Page HOSTING and caching are services prohibited with your DSL connection.
The company makes and has made no representation or warranty with respect to the
duration or period of this Agreement. Customer agrees and acknowledges the
company shall have the right, but not the obligation, to terminate or cancel
this Agreement and the service provided by the company to the customer without
liability for any reason and at company’s sole discretion.
The customer must accept inside wire maintenance as long as the customer
receives DSL service from this company. Refusal to accept inside wire
maintenance disqualifies the customer’s eligibility to receive DSL service from
the company. Should the customer discontinue the company’s inside wire
maintenance, then the DSL service will be discontinued.
The trial period for evaluating DSL service will be 5 days beginning on the
installation date. If during the 5 day period the customer decides to remove DSL
service the customer will still be responsible for all installation cost. The
modem and any equipment installed will be removed from customer location.
Should the customer’s service be disconnected before the duration of this
one-year agreement, the customer will still be responsible for all installation
charges. The modem and any equipment installed will be removed from customer
location. If removal of the modem and equipment isn’t possible, the customer
will be responsible for the cost of those items.
