PEOPLES RURAL TELEPHONE COOPERATIVE
DSL/TELEVISION SERVICE AGREEMENT
FOR NEW SUBSCRIBERS 

This Agreement is made by the individual or authorized person of the organization (“Customer”) identified below and Peoples Rural Telephone Cooperative, its subsidiaries, successors and associated companies including Peoples Telecom (“PRTC”). PRTC and the Customer agree to the following conditions concerning Digital Subscriber Line (DSL) and/or television service provided by PRTC to the Customer.

1. PRTC DSL is a “best effort” service, which can provide Up Stream and Down Stream speeds selected by the customer. The actual speed experienced by the Customer may vary and depend on several factors not limited to but including customer location, the destination on the Internet, traffic on the Internet, interference with a high frequency spectrum on the customer’s telephone line and other devices that may be attached to the same cable pair. No minimum level of speed is guaranteed without a specific service agreement.
2. PRTC television service is a “best effort” service and the quality of that service may vary and depend on several factors including but not limited to customer location, content provider transmissions, signal strength and customer-owned equipment.
3. For DSL service, PRTC is not responsible for any external intrusion to the Customer’s network equipment. The Customer is responsible for providing firewall protection in an effort to help prevent intrusions. Since the service is an “always on” connection, it is PRTC’s recommendation that each Customer has appropriate firewall protection on their equipment when using PRTC DSL service.
4. PRTC is not responsible for any customer-owned equipment or network malfunctions and/or damage to the Customer’s hardware or software. Customer agrees to protect all equipment provided by PRTC from damage, including electrical surges and low-voltage damage.
5. PRTC provides DSL and television services on a retail basis to the Customer. The Customer agrees to utilize the service exclusively and not to provide access to third parties either through “sharing“ or “resale.”
6. Web page hosting and caching services are prohibited with your DSL connection.
7. PRTC makes and has made no representation or warranty with response to the duration or period of this Agreement. Customer agrees and acknowledges PRTC shall have the right, but not the obligation, to terminate or cancel this Agreement and the service(s) provided by PRTC to the customer without liability for any reason and PRTC’s sole discretion.
8. The Customer must accept inside wire maintenance as long as the Customer receives DSL service from PRTC. Refusal to accept inside wire maintenance disqualifies the Customer’s eligibility to receive DSL service from PRTC. Should the Customer discontinue PRTC’s inside wire maintenance, then the DSL service will be discontinued?
9. Should the Customer’s service be discontinued for any reason, including Customer request or non-payment, within one year of the date of this Agreement, the Customer will still be responsible for all service installation charges. These charges are currently $185.00 for DSL ($211 for standalone) and $50 (pre-existing service location) or $100 (all other locations) for television.
10. Upon termination of the installed services or at the request of PRTC, modems, set top boxes, remotes and any other (non-Customer owned) equipment installed by PRTC must be returned to PRTC clean and in good working order as it was received. If the equipment is not returned to PRTC clean and in good working order, the customer will be responsible for the cost of those items. A price list for all PRTC installed equipment is available on request.
11. Customer agrees to pay PRTC all charges described in this agreement and any late fees, collection costs, attorney’s fees or other fees incurred in the collection thereof. Any federal, state or local sales tax, as well as regulatory fees, will be billed separately.
